These Terms of Service (“Terms”) govern your access to and use of the Tripflip mobile apps, website at tripflip.app, and related services (the “Services”) provided by Tripflip (“Tripflip”, “we”, “us” or “our”).
By downloading, accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Tripflip helps you discover places to eat, drink and explore and organise them into plans. Features may change over time. Some recommendations and place data are powered by Tripadvisor and other third parties; their content remains subject to their own terms.
2. Eligibility
You must be old enough to form a binding contract in your country (and at least 13, or the higher age required where you live) to use the Services. If you use Tripflip on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Accounts
You may need an account for some features. You are responsible for your credentials and for activity under your account. Tell us promptly if you suspect unauthorised use. We may suspend or terminate accounts that violate these Terms or create risk for other users or the Services.
4. Acceptable use
You agree not to:
- Use the Services for unlawful, harmful, fraudulent or misleading purposes.
- Scrape, bulk-export or reverse engineer the Services except as allowed by law.
- Interfere with or disrupt the Services, other users, or our infrastructure.
- Misrepresent your identity or affiliation, or attempt to access another user's account.
- Use the Services to infringe intellectual property or privacy rights.
5. Content and intellectual property
Tripflip, Tripadvisor and their licensors own the Services, branding, software and most place content. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes as intended.
If you submit content (reviews, photos, feedback or similar), you grant Tripflip a worldwide, non-exclusive, royalty-free licence to host, use, reproduce and display that content in connection with operating and improving the Services. You represent that you have the rights needed to grant this licence.
6. Third-party services
The Services may link to or rely on third parties (maps, app stores, Tripadvisor content, analytics). We are not responsible for third-party services, and their terms and privacy policies apply when you use them.
7. Disclaimers
The Services and all place information are provided “as is” and “as available”. We do not guarantee that opening hours, prices, availability, ratings or directions are complete or up to date. Always confirm important details before you travel. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, Tripflip and its affiliates, officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the claim or (b) USD $50. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.
9. Indemnity
You agree to defend and indemnify Tripflip against claims, damages and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms, to the extent permitted by law.
10. Termination
You may stop using the Services at any time. We may suspend or end access if you breach these Terms or if we discontinue the Services. Sections that by nature should survive (including intellectual property, disclaimers, liability limits and indemnity) will survive termination.
11. Changes
We may update these Terms by posting a new version on this page and updating the “Last updated” date. If changes are material, we may provide additional notice. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws applicable in the jurisdiction where Tripflip is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
